September 2017
Thomas Hoffman filed a lawsuit in St. Clair County, Illinois, against Syngenta and Growmark. He claimed he was exposed to the substance at a young age and developed Parkinson’s disease as a result.
April 2021
Because of the growing number of similar claims filed throughout the United States, a Motion of Transfer was filed to centralize these cases into a Multidistrict Litigation (MDL).
June 2021
The Judicial Panel on Multidistrict Litigation (JPML) of the United States ordered that all federally filed paraquat lawsuits be centralized in the Southern District of Illinois. Judge Nancy J. Rosenstengel was set to preside over the litigation. In sixteen different districts, 77 actions are currently pending.
July 2021
174 cases are pending in federal courts so far, with additional cases pending in California, Missouri, and Illinois.
In a case management order, Judge Nancy J. Rosenstengel announced the sixteen lawyers that will represent the sixteen lawsuits over the herbicide paraquat.
November 2021
In an attempt to push the plaintiffs, the defendants requested to dismiss particular claims that suggest paraquat exposure to Parkinson’s disease. They requested that due to time restrictions known as the statute of limitations, some other claims should be dismissed as well.
In response, plaintiffs claim that defendants’ motions violate the fundamental purpose of an MDL, which is to ensure pretrial proceedings lead to the efficient, just, and expeditious resolution of all actions. The jury denied that proposal, and the plaintiffs were ordered to respond until December 2021.
December 2021
Class action judge Nancy J. Rosenstengel released an order issuing all plaintiffs filing a lawsuit from now on are required to complete the Plaintiff’s Assessment Questionnaire. The PAQ’s goal is to assess incoming cases relating disease to paraquat exposure.
As of December 2021, 482 cases are pending in federal courts– an exponential growth compared to the initial date of the MDL class action opening in June.
In a new case management order, the MDL judge issued the lawyers to complete a fact discovery check on the plaintiffs’ claims to proceed with the final pretrial conference of the chosen trial dates.
February 2022
Six hundred eighty-eight actions are now pending in federal courts– an exponentially progressive growth compared to previous months.
March 2022
The jury determined which cases would go to a bellwether trial, and the court gave both parties until April 8 to submit their case rankings based on trial scheduling preference. In November 2022, the first round of bellwether test trials will begin.
Meanwhile, the cases pending in federal courts as of March 16, 2022, are 875.
June 2022
The judge amended the order issued on March 2022. The new order sets July 25, 2022, as the deadline for completing fact discovery and medical examinations in the six bellwether trial cases.
August 2022
The judge issued an order postponing the first bellwether trial from November 2022 to July 2023.
The news that settlements will be delayed for another nine months and the rapid increase in the pending cases (1,749 in federal courts) is upsetting the plaintiffs.
September 2022
The lawsuits continue to increase with the same exponential rhythms, with 1,925 cases pending as of September 15, 2022.
December 2022
The judge once again postponed the date of the initial bellwether trials, this time from July 2023 to October 2023. These are frustrating news, but mass tort litigation lawyers advise plaintiffs to continue holding tight until the cases’ settlements.
